What are deepfakes?

Deepfakes are media content—images, videos, or audio files—generated or manipulated using artificial intelligence that depict a real person in a false context. The technology is based on deep learning and neural networks, which use training data (photos, videos, audio material) of a person to create deceptively realistic fakes.

Types of Deepfakes

  • Face Swap: A person’s face is superimposed onto an existing video or photo—often into pornographic material.
  • Deepfake pornography (deepnudes): AI generates nude images or explicit videos of a person from ordinary photos. 96% of all deepfakes fall into this category.

Legal situation: Are deepfakes a criminal offense in Germany?

The legal situation in Germany is currently evolving rapidly. Here is the current status:

Currently applicable laws

§ 185 StGB – Defamation

Deepfakes can be considered defamation, particularly in the case of sexual or degrading depictions.

§ 201a StGB – Violation of the highly personal sphere of life

Protects against the unauthorized production and distribution of images taken in intimate situations.

§ 22 KunstUrhG – Right to one’s own image

Prohibits the distribution of images of a person without their consent.

EU Digital Services Act (DSA) & Digital Services Act (DDG)

Art. 16 DSA requires platforms to establish notice-and-action procedures and to promptly address complaints regarding illegal content—including violations of personality rights caused by deepfakes. Effective as of February 2024 for all online platforms in the EU.

Planned legislative changes

Legislation continues to evolve in favor of those affected:

  • § 184k StGB – Violation of privacy through photographic images: A specific draft bill from the Federal Ministry of Justice specifically penalizes the production and distribution of sexualized deepfakes with up to 2 years’ imprisonment. Since 96% of all deepfakes are of a pornographic nature, this provision is particularly relevant for those affected.
  • § 201b StGB: In July 2025, the Federal Council adopted a supplementary draft bill—up to 2 years’ imprisonment for harmful deepfakes, up to 5 years for deepfake pornography and political manipulation.
  • Requirement to file a criminal complaint: Victims must file a criminal complaint for the public prosecutor’s office to take action.

Both draft bills are currently undergoing parliamentary proceedings. Regardless of the outcome, leak.red already offers the technical means to actively combat deepfakes—as a supplement to legal action.

EU AI Act (Art. 50)

The EU AI Act regulates AI-generated content across Europe. The mandatory transparency and labeling requirements for AI-generated content under Art. 50 will take full effect in August 2026. This will legally oblige platforms even more strongly to cooperate regarding unlabeled deepfakes—significantly strengthening the position of those affected.

AI-powered facial recognition processes biometric data to identify deepfakes. This data falls under the special categories of personal data pursuant to Art. 9(1) GDPR. Processing is carried out exclusively on the basis of your explicit consent (Art. 9(2)(a) GDPR), which is obtained separately as part of the onboarding process.
